Waiver of Liability
It is the intention of Tuscan Muse and the participating Instructors to conduct a workshop or tour while Participants are guests at Le Casacce, Seggiano, Tuscany, Italy or Le Citte, Santa Fiora, Tuscany, Italy for the period of time as described on the website for each workshop or tour on www.tuscanmuse.com.
I hereby agree to participate in the Workshop or Tour during the dates advertised. By full payment for the Workshop or Tour I acknowledge the terms in this Responsibility Waiver and my acceptance of the nature and content of the Workshop or Tour.
I acknowledge and accept that Tuscan Muse and the Instructor act only as agents for the various modes of transportation conveyances provided during the designated workshop or tour. Tuscan Muse and the Instructor assume no responsibility or liability in connection with the services that may be used, either wholly or in part, in the performance of its duty to the passenger, or for any hotel proprietor, or hotel service or for any other person engaged in carrying out the purpose for which services were requested.
In the event that it becomes necessary or advisable for the comfort or well-being of the participants or for any reason whatsoever, to alter the itinerary or arrangements; such alternatives may be made without liability or penalty to Tuscan Muse and the Instructor. Further, Tuscan Muse and the Instructor accept no responsibility for loss of tickets or personal articles and effects, nor for personal accidents, injury or death, nor for losses or additional expense due to delays or damage in transportation or other services, quarantine, sickness, strikes, war or warlike conditions, weather or any other cause.
Tuscan Muse reserves the right to increase the costs of the Workshops in Tuscany or Tours of Tuscany to take into account the following: acts of God, government action, change of currency exchange rates and increased transportation costs, including the cost of fuel.
It is strongly recommended that the Participant take out suitable travel insurance in order to take part in our Workshops in Tuscany or Tours of Tuscany organized by Tuscan Muse. Participants are wholly responsible for arranging their own insurance. A suitable insurance policy should provide adequate coverage for medical expenses arising through illness or accident prior to or during the Workshops in Tuscany or Tours of Tuscany and loss of the Workshop or Tour fees through cancellation and curtailment of the Workshop or Tour for insurable reasons.
Tuscan Muse is able to assist Participants in obtaining a suitable insurance policy through World Nomads. A quote and purchase of insurance through World Nomads is available on the home page of this website. Participants making their own arrangements should ensure that there are no exclusion clauses limiting protection for the type of activities in their Workshop or Tour. Participants should satisfy themselves that any travel insurance arranged through Tuscan Muse is what they require and should arrange supplementary insurance if need be.
It is the Participants' responsibility to ensure that she/he and the members of his or her Party do not behave in a way which causes offense or danger to others or which risks damage to property belonging to others. In such circumstances all suppliers (e.g. hotel managers and transportation companies) and Tuscan Muse have the right to terminate arrangements made on the Participants' behalf, in which case Tuscan Muse's responsibility to the Participant ceases immediately. Therefore, Tuscan Muse will not be liable for any refunds, payment of compensation or reimbursement of any cost or expenses incurred as a result. Further, the Participant will be liable to reimburse Tuscan Muse for any expenses whatsoever that it incurs as a result of such behavior.
Age, Fitness & Participation
All Participants are expected to satisfy themselves prior to booking that they are fit and able to complete the itinerary of their chosen Workshop or Tour as described by Tuscan Muse. Some of our Workshops and Tours are not suitable for those unable to walk long distances, or climb and descend the steep streets of many of the cities and villages in Tuscany. This is not a physically challenging trip, nonetheless there will be plenty of walking uphill and standing for extended periods of time. If you are
not interested in some of the scheduled activities, you can stay at the accommodation and relax, or we can plan a different activity for you (additional fees may occur). During the day trips, you will have free time on your own, during which you decide whether you prefer being more or less active. However, this is not a recommended trip for those with mobility issues or health concerns.
Children of age 18 or under may travel provided that they are accompanied by a parent or a guardian who accepts full responsibility for them and is subject, in all cases, to the ultimate discretion of Tuscan Muse. Participants agree to accept the authority and decisions of Tuscan Muse and their employees, tour leaders, instructors and/or agents while participating in a Workshop or Tour with Tuscan Muse. If in the opinion of such person, the health or conduct of a Participant before or after the departure appears likely to endanger the safe, comfortable or happy progress of the Workshop or Tour, the Participant may be excluded from all or part of the Workshop or Tour, in which case all monies paid will be forfeited and Tuscan Muse will not be liable to pay any compensation whatsoever to such Participant.
All Participants in Workshops or Tours operated by Tuscan Muse are expected to obey the laws and regulations of Italy and those of the region of Tuscany and any failure to do so will relieve Tuscan Muse of all obligations that it may otherwise have under the Contract.
Illness and Disability
Anyone suffering from illness or disability or undergoing treatment for any physical, psychiatric or medical condition must declare the true nature of such condition at the time of booking and make arrangements for the provision of any medication or other treatment required during the Workshop or Tour. Failure to make such disclosure will constitute a breach of these Booking Conditions and may result in such persons being excluded from the Workshop or Tour in which case all monies paid will be forfeited and Tuscan Muse will not be liable to pay any compensation whatsoever.
If the Participant has a complaint about any of the Workshop or Tour arrangements, the Participant must bring it to the attention of Tuscan Muse or other representative of the Company at the time, so that they may use reasonable endeavors to rectify the situation. Failure to complain at the time will affect the Participant's ability to claim compensation from Tuscan Muse. Should the problem remain unsolved, a complaint must be made in writing to Tuscan Muse within a reasonable period of not more than thirty (30) days after the completion of the Workshop or Tour.
Special Requests Including Dietary Restrictions
If the Participant has any special requests, he/she should inform Tuscan Muse at the time of booking. Tuscan Muse and its suppliers will try to meet such requests but, as these do not form part of the Contract, Tuscan Muse does not guarantee to do so. The Participant will be specifically notified if a special request cannot be met for those requests revealed to Tuscan Muse at the time of booking. Tuscan Muse does not accept bookings which are conditional on the fulfillment of any special request.
Cancellation by Tuscan Muse
I acknowledge and accept that Tuscan Muse and/or the Instructor reserve the right to cancel the Workshop or Tour should certain conditions warrant, in which event, each "paid in full" participant will receive full reimbursement.
Cancellation by Workshop or Tour Participant- Tuscan Muse Refund Policy
In the event that any participant must cancel their reservation for a workshop or tour, I agree that there will be a $500 cancellation fee, which is the amount of the initial deposit required for registration of the workshops or tours. Cancellation during the thirty (30) day period prior to the workshop or tour will result in forfeiture of the entire registration fee.
Tuscan Muse reserves the right to photograph and film its workshops and tours in entirety. Participants should be aware that images of them may be used for promotional purposes or joint marketing efforts with third parties, without remuneration.
This Contract, Liability Waiver and Cancellation Policies is constituted by Tuscan Muses' acceptance of the Participant's booking and shall constitute the entire agreement between the Participant and Tuscan Muse in relation to the relevant booking, and shall exclude all other terms and conditions (except for the relevant suppliers' conditions and any applicable international conventions) and shall supersede all prior or contemporaneous communication or information provided.
The Contract, Liability Waiver and Cancellation Policies and all matters arising from it, is subject to United States Law and the exclusive jurisdiction of the State of Georgia.
Acceptance of Terms
I have read the above and agree to abide by these conditions. I also have read and understand fully the
Conditions set forth in the Tuscan Muse Refund Policy. My signature, as it appears on this document
verifies my acceptance of this Contract, Waiver of Liability and Cancellation Policies.
